Partner visits London Inn of Court

Mark Stubbs, current president of the first organized American Inn of Court, The A. Sherman Christensen American Inn of Court, was recently a guest at Lincoln's Inn in London, one of the four English Inns of Court.  Lincoln's Inn has 18,000 members world wide.  A trial lawyer in England, a barrister, must be a member of one of the Inns in order to practice in English courts.

Firm wins another Utah Supreme Court case

The firm recently prevailed again at the Utah Supreme Court, in a decision issued Friday, 12 March 2010.  The Court ruled 5-0 that officers violated our client’s Fourth Amendment rights to be free from unreasonable searches and seizures.  The Court held that the Fourth Amendment requires officers to release passengers in a vehicle involved in a traffic stop as soon as the purposes of the traffic stop are complete.  Aaron Dodd, an associate with our firm, was appointed by the court to represent the indigent defendant.  The court's opinion can be found here.


Partner Elected Chairman of Hospital Board

The firm’s senior partner, Bill Fillmore, was elected to serve as Chairman of the Board of Trustees for Timpanogos Regional Hospital in Orem.  Bill has served for the past two years as a member of the Board, along with several other prominent leaders in our community.   Bill commented,  “Given the national healthcare debate that continues to rage from coast to coast, it is a fascinating time to participate on a hospital board and be right in the middle of the many major healthcare policy issues facing our country.” A Daily Herald story about Bill's chairmanship appears here.


Firm prevails at Utah Supreme Court

The Utah Supreme Court ruled 5-0 yesterday (9 February 2010) that the former wife of a doctor can sue her ex-husband after she financially supported him through medical school "in exchange for [his] promise of a higher standard of living."  Scott Card and Matt Howell represent Gloria Ashby in the case.  This represents a substantial development in Utah law protecting those who provide the financial support during their spouse's education.  The court's opinion appears here.


Mark D. Stubbs - Visiting Faculty in Ukraine

Mark D. Stubbs, a member of Fillmore Spencer, LLC, has been selected by the Leavitt Institute For International Development as a visiting faculty member at Ivan Franko National University of L’viv, Ukraine and the Uriy Fedkovych Chernivtsi National University in Chernivtsi, Ukraine.  The Leavitt Foundation is a Charitable Organization of experienced professionals devoted to improving the rule of law in developing democratic nations of the world.  Mr. Stubbs will instruct the law students at these two universities in the laws of evidence as used in the legal system in the United States.


One of our own goes to Haiti to aid in relief efforts

Jamie Preston, wife of Scott Preston, an Associate with Fillmore Spencer, LLC,  was asked to join with the Utah Hospital Task Force in providing aid to victims of the earthquake in Haiti.  She is one of 70 translators that speak Haitian Creole and part of the largest single group of Creole speakers sent to Haiti.  She has already worked with medical personnel from numerous countries, the UN, and other Non-Governmental Organizations in providing her translating skills.  She is expected to stay in Haiti for at least two weeks.  For more information about the Utah Hospital Task Force or to follow the work being done by this group, please go here or here.

At the 7 January 2010 luncheon, the Cougar Club paid tribute to his more than two decades of supporting BYU's student athletes. Bill is the former national president of the Cougar Club. Utah Supreme Court Ruling Favors Firm's Client

On 16 June 2009, the Utah Supreme Court issued a ruling in favor of Fillmore Spencer’s client, William Jacob  (Case No. 20060856).  The Utah Supreme Court’s ruling brings to a close a battle which has been ongoing since the year 2000.  In October of 2003, Mr. Jacob filed a motion to dismiss his claim for defamation against the opposing party, but the opposing party refused to allow the case to be dismissed.  Instead, the opposing party chose to claim that Mr. Jacob’s defamation claim was a violation of the Strategic Litigation Against Public Participation (SLAPP) in government act, and thereby sought substantial sanctions against Mr. Jacob for bringing a simple defamation action after his reputation for honesty had been attacked.  The Utah Supreme Court vindicated the arguments advanced by Mr. Spencer and declared that the SLAPP act did not apply to the simple defamation claims at issue in the case; accordingly, as Mr. Jacob had sought  6 1/2 years earlier, the case was finally dismissed.
